Brothers and Sisters,

Here it is. The lawsuit to join for this longest shutdown in US history.  Thank you for your support and dedication to the job.  We know everyone is struggling in different ways.  Hang in there and PLEASE SIGN UP FOR THIS LAWSUIT!!

            Please share this with ALL FEDERAL EMPLOYEES and use it AS A RECRUITING TOOL FOR UDLC.  We are close to 50% of UD eligible members. Thank you again for your support.  And be patient for the lawsuit to win and be paid out.  The 2013 shutdown lawsuit has yet to be paid out.

Here are some IMPORTANT FACTS about the case:

1.         You MUST fill out and submit the form on our website to join the case and be eligible to receive damages

Unlike traditional class actions where people are automatically included, you MUST sign up to be part of a case alleging a violation of the Fair Labor Standards Act (“FLSA”).  Only the people who fill out and submit the necessary forms will be eligible to recover damages from our case.  The link to the sign-up form is:

2.         The case is for ALL affected employees

While we are delighted to work with the American Federation of Government Employees (“AFGE”) on the case, you do NOT need to work in an AFGE bargaining unit or be a member of any particular union to join the case.  Just as with the 2013 case, it is brought on behalf of ALL affected employees.

3.         Heidi Burakiewicz, a partner at KCNF, obtained a decision in her case from the 2013 shutdown that the government violated the FLSA and owes liquidated damages to federal employees

Heidi Burakiewicz, who filed the only lawsuit on behalf of federal workers following the 2013 government shutdown, obtained a ruling in that case that the government (1) violated the FLSA when it failed to pay covered employees who continued to work during the shutdown on their regularly scheduled payday and (2) was liable for liquidated damages because it failed to act in good faith. 

Following that victory, Heidi Burakiewicz and the law firm Kalijarvi, Chuzi, Newman & Fitch (“KCNF”), in conjunction with AFGE, filed the first lawsuit against the United States related to the 2018-2019 Government Shutdown on behalf of federal employees being forced to work without pay.  Many of you learned about the case because of the considerable media attention it has garnered including on CNN, MSNBC, the Washington Post, Washington Examiner, NPR’s All Things Considered, Federal News Network, etc.  To read more about press surrounding the case go to:

We are disheartened that the shutdown continues and about how it negatively affects so many people.  We are still working through the over 10,000 emails that we have received about the shutdown and are trying to answer each question as soon as possible.  In the meantime, we are working on preparing a link on our firm’s website ( with information about the most frequently asked questions.
